1.2 閣下訪問、瀏覽、註冊帳戶或使用本服務，即被視為已：（a）閱讀、理解並同意受本條款及本公司的《私隱政策》約束；及（b）聲明自己已年滿 18 歲，或在家長／監護人明確同意及監督下使用本服務。

2. 非醫療建議及緊急情況聲明（核心合規條款）
2.1 本網站載列或透過本服務展示的所有資料，包括但不限於健康資訊、醫療科普文章、圖像、影片、圖表、健康風險評估結果、藥物或治療相關介紹，以及由人工智能（AI）系統生成的任何內容（統稱「健康資訊」），僅供一般健康教育及資訊參考用途，並不構成亦不應被視為註冊醫生、藥劑師或其他醫護專業人士作出的臨床診斷、專業意見或治療建議；面診、檢查、化驗、第二意見或任何形式的醫療程序；或對任何具體個案的醫療疏忽責任承擔或專業醫療服務。

2.3 本網站及本服務並不提供緊急或即時醫療服務。若閣下出現嚴重、急性或可能危及生命之狀況（包括但不限於胸痛、持續呼吸困難、昏迷、大量出血、嚴重過敏反應等），請立即致電 999 或前往最近醫院急症室求診。
3. 人工智能（AI）及自動化服務之特別說明
3.1 本服務部分功能使用人工智能及自動化技術，包括大型語言模型（LLM）、機器學習演算法及決策支援系統（統稱「AI 服務」）。
3.2 閣下了解並同意，AI 服務具有以下技術限制：AI 內容可能出現描述不準確、資料不完整、過時或與最新醫學共識不完全一致的情況；AI 服務一般無法全面掌握閣下完整個人病歷、體質、檢查結果及處方歷史，故不構成對任何個別個案的專屬臨床建議；AI 輸出結果基於統計與概率推算，僅作輔助參考。
3.3 本公司不就任何 AI 服務輸出的準確性、完整性、適用性或符合特定目的之程度作出任何明示或默示保證。閣下使用或依賴 AI 服務所產生之任何風險，概由閣下自行承擔。
3.4 為改善 AI 服務，本公司可能使用已去識別化及匯總後之數據進行模型訓練與效能評估。相關安排將依照本公司的《私隱政策》及香港《個人資料（私隱）條例》進行。
4. 法規遵從聲明（《商品說明條例》、《不良醫藥廣告條例》等）
4.1 本公司在提供本服務及展示內容時，將力求遵守香港適用法例，包括但不限於《商品說明條例》（第 362 章）、《不良醫藥廣告條例》（第 231 章）及《個人資料（私隱）條例》（第 486 章）。
4.2 涉及任何藥物、醫療器材、保健產品或醫療服務之介紹，如來自第三方（包括藥廠或合作機構），均以其提供之資料為基礎。本公司不保證該等資訊之完整性或持續有效性，亦不構成對相關產品或服務之招攬、推薦、背書或廣告宣傳。
4.3 如本網站載有之內容與政府部門、監管機構、專業學會或同行評審文獻之官方指引有所差異，概以後者為準。
5. 不保證條款與風險自負
5.1 本服務按「現況」（as is）及「可得性」（as available）基礎提供。在適用法律允許的最大範圍內，本公司不就任何健康資訊、AI 內容或第三方資料之準確性、完整性、時效性及適用性；本服務不會中斷、延誤、出錯或受病毒、惡意軟件、網絡攻擊或其他外來干擾；或使用本服務必然能改善閣下健康、降低疾病風險或達致任何特定結果作出任何明示或默示保證。
5.2 閣下明確同意，因使用或依賴本網站、本服務或任何健康資訊所引致之所有風險，均由閣下自行承擔。
6. 責任限制（平台核心保障）
6.1 在不違反香港法例（包括但不限於《控制免責條款條例》（第 71 章））之前提下，於適用法律允許的最大範圍內，本公司、其董事、僱員、顧問、代理、關聯公司、合作夥伴及技術供應商，就閣下使用、無法使用或誤用本網站或本服務；閣下依賴任何健康資訊或 AI 服務輸出結果；任何通訊或數據傳輸之延誤、中斷、錯誤或遺漏；任何未經授權之存取、更改或毀損；及任何第三方網站、內容、產品或服務所引致或相關之任何索償、損失或損害，概不承擔任何責任。
6.2 在任何情況下，如本公司須就本網站或本服務承擔賠償責任，本公司之總累積賠償額將以下列兩者中較低者為上限：（a）港幣一百元正（HKD 100）；或（b）在相關索償事由發生前 12 個月內，閣下就本服務實際向本公司支付之總費用（如有）。
6.3 上述責任限制並不排除本公司在法律上不可限制或排除之責任，包括因本公司疏忽引致之死亡或人身傷害。

10. 知識產權
10.1 本網站之版面設計、商標、標誌、文字、圖像、影音內容、程式碼及 AI 模型等，除另有標示外，均屬本公司或其授權人之知識產權。
10.2 未經本公司書面同意，任何人士不得複製、改編、分發、公開展示、上載、下載、爬蟲抓取（Web Scraping）或將本網站之任何部分用於商業用途。
11. 服務修改及中止
11.1 本公司保留隨時修改、暫停或終止本網站或本服務之全部或部分之權利，無需事先通知。
11.2 本公司對於因上述行動所可能引致之任何損失，概不承擔責任。
12. 適用法律及爭議解決

5. Limitation of Liability
Subject to applicable law and to the fullest extent permitted, HealthHub.hk, Healthhub AI Group Limited, its directors, employees, advisors, affiliates, partners and technology providers shall not be liable for any direct, indirect, incidental, consequential, punitive or special loss or damage arising out of or in connection with your use of the Website or Services, reliance on health information or AI Content, technical failure, or third-party websites, content, products or services. If we are found liable, our aggregate liability shall not exceed the lower of HKD 100 or the amount paid for the Services in the preceding 12 months.
